March 2019 saw the publication of Royal Decree-Law 6/2019, of 1 March, developing, among others, Organic Law 3/2007, of 22 March, for effective equality between women and men, which introduces urgent measures to guarantee equal treatment and opportunities for women and men in employment and occupation. Among these new features, it is worth highlighting the mandatory implementation of gender equality plans in companies, which will be enforced gradually according to the following timeframe:
- From 8 March 2020, it will be mandatory for companies with over 150 to 250 employees
- From 8 March 2021, it will be mandatory for companies with over 100 to 150 employees
- From 8 March 2022, it will be mandatory for companies with 50 to 100 employees.
These gender equality plans must meet minimum standards in terms of content, and be registered with the Registry for Equality Plans of companies.
The regulations also require all companies to keep a record of salaries in order to ensure gender pay equality.
Issues such as preliminary assessment, evaluation, recording and monitoring of gender equality plans are still to be developed by the Spanish authorities, but this is expected to be done soon since the new regulations are already applicable.
